Terms and Conditions of Lake Neusiedl Card

The following terms and conditions are deemed to have been explicitly agreed for the issue and use of the Lake Neusiedl Card.

Product description

The Lake Neusiedl Card allows all authorized persons (except e.g. commuters) who stay overnight at one of the Lake Neusiedl Card inclusive accommodations during the Lake Neusiedl Card season and who have registered in the official guest directory sheet for the specific purpose or online, to use the listed services of the Lake Neusiedl Card partner businesses. In addition, there are bonus services which are also outlined in this brochure.

 

Scope of service / Disclaimer

All Lake Neusiedl Card partner businesses listed in this brochure have committed themselves to offering their Lake Neusiedl Card services in full, both qualitatively and quantitatively, to Lake Neusiedl Card holders in accordance with and subject to their own general terms and conditions of carriage and business.

Holders of the Lake Neusiedl Card acknowledge that the operating hours of some partners do not fully coincide with the validity period of the Lake Neusiedl Card season, primarily due to reasons of weather and season. For capacity reasons, waiting times may be longer at some businesses. Lake Neusiedl Card holders submit to the stated opening hours, any access restrictions and capacity management instructions by the partner businesses and waive any claims for damages if, due to operational reasons or through no fault of the service partners, services are not offered at all or only in parts. 

The service partners are liable only for gross negligence and wilful intent, not however for slight negligence. Moreover, they do not accept any liability for any wardrobe or other valuables brought along. Furthermore, holders of the Lake Neusiedl Card acknowledge that Neusiedler See Tourismus GmbH is entitled to terminate the agreement with individual Lake Neusiedl Card service partners for good cause, even during the season, and no claims whatsoever can be asserted as a result. In total, a maximum of 2 discounted one-way trips per Lake Neusiedl Card are possible on selected Lake Neusiedl Card bike ferries per calendar day on the lake.

 

Conditions of issue

The inclusive accommodations have committed themselves to drawing guests’ attention to the Lake Neusiedl Card, regardless of the length of their stay. Guests who stay at an inclusive accommodation will receive from their host the blue copy or the online registration of the official guest directory sheet in which the guest has registered upon arrival for the duration of their stay in accordance with the statutory provisions.

The Lake Neusiedl Card is issued at authorized issuing offices listed in the brochure after submission of the blue copy or the online registration of the official guest directory sheet and presentation of identification for the duration of the stay as listed in the guest directory sheet (in print as a card or in digital format on the smartphone). Guests must sign the guest directory sheet on the reverse side/online registration at the bottom. By signing or registering for the digital card in the PIA (Personal Interests Assistant), the acceptance, terms of use, T&Cs and GDPR are confirmed. Your signature or registration for the digital card in the PIA (Personal Interests Assistant) is also valid as consent and confirmation for all your accompanying persons who are listed on the registration form. It is not possible to issue a Lake Neusiedl Card without your consent (signature or registration in the PIA)! A digital card via the PIA can only be used if the inclusive accommodation is a member business of the PIA. When using the digital guest card in the PIA, registration (activation of the account) of the guest for this progressive app is required.

 

Non-transferability

The Lake Neusiedl Card is not transferable and only valid in conjunction with a valid photo ID. It may therefore only be used by the person whose name appears on the card (printed or digital) or is stored in the respective code. No substitute benefits or reduction of the price of accommodation may be claimed if the Lake Neusiedl Card is not used.

 

Loss/Theft

Cardholders are obliged to report the loss or theft of the Lake Neusiedl Card to the issuing office where they received the Lake Neusiedl Card in order to have it blocked. Only this issuing office can issue a new card, if necessary, after checking the plausibility of the incident. There is no legal claim to replacement of the card or to a reduction of the price of accommodation.

 

Validity

The Lake Neusiedl Card season extends from March 1, 2021 to February 28, 2022. The Lake Neusiedl Card is valid throughout the guest's reported period of stay from the date of arrival to the date of departure.

 

Sale of the Lake Neusiedl Card

The card is not on sale for the general public. Only guests who are staying at an inclusive accommodation and are registered are entitled to the card. 

 

Children

All persons listed in the guest directory sheet aged three or older receive the Lake Neusiedl Card. Children up to three years of age are covered automatically. For the purpose of this provision, children shall be deemed biological or adopted descendants who are recorded as accompanying children on the guest directory sheet.

 

Use

In order to obtain the card benefits, cardholders shall present their Lake Neusiedl Card, which is checked for validity and identity by the Lake Neusiedl Card service partner using an acceptance device or by mere visual inspection and recording of the card number and the name of the cardholder. Cardholders are obliged to present a valid photo ID upon request. Failure to do so may result in being denied free admission or the service associated with the Lake Neusiedl Card.

 

Damage

If a card is damaged, presents technical defects or similar, guests are advised to contact the office that issued the Lake Neusiedl Card. Only this issuing office can, if necessary, replace a damaged card with a new Lake Neusiedl Card, after having checked the plausibility of the incident.

 

Early departure

Cardholders departing prior to the date shown as the provisional date of departure in the guest directory sheet must surrender the Lake Neusiedl Card to their accommodation without being asked do so, or have the digital card blocked. The Lake Neusiedl Card loses its validity on the day of departure.

 

Misuse

In case of misuse or suspected misuse, the Lake Neusiedl Card service partners have the right and/or obligation to withhold the card without compensation and to have it blocked. Cardholders are liable for misuse of the card by third parties. There is no legal claim to replacement of the card or reduction of the accommodation price.

 

Exclusion of liability of Neusiedler See Tourismus GmbH 

Holders of the Lake Neusiedl Card acknowledge that Neusiedler See Tourismus GmbH is only responsible for the administrative handling of the Lake Neusiedl Card between the holders and the service partners or the inclusive accommodation providers. Holders of the Lake Neusiedl Card waive any conceivable warranty claims or claims for damages against Neusiedler See Tourismus GmbH, irrespective of whether the service or accommodation providers are at fault for any loss or damage or not. In the event of any liability arising, Neusiedler See Tourismus GmbH shall not liable for any such loss or damage, especially since neither the accommodation nor the service partners are auxiliaries of Neusiedler See Tourismus GmbH. Likewise, holders of the Lake Neusiedl Card are not entitled to any compensation from Neusiedler See Tourismus GmbH should any services listed in the brochure not be performed by partner businesses.

 

Jurisdiction

The court having jurisdiction for Eisenstadt shall have exclusive jurisdiction for any and all disputes arising from the use of the Lake Neusiedl Card or any claims for damages or warranty claims. Austrian law shall apply exclusively.

 

*Partner businesses is the umbrella term for accommodation providers, service partners, bonus and super bonus partner businesses. Accommodation providers are accommodations in the Lake Neusiedl region. Service, bonus & super bonus partner businesses are establishments in the region that offer free services, bonus services or discounts to holders of the Lake Neusiedl Card.
